Notarised signature

You have concluded a sales or donation contract, or any contract with which you have transferred your ownership rights to a third party, perhaps a contract where you transferred the right to use the real property to the third party without possessing it. How to proceed?

If the third party wishes to enter his/her right in the land register, your signature on the contract will have to be verified. Such verification proves the authenticity of your signature. The contract requires preliminary signature of all contractual parties. For the notarised signature you need your official identity document (identity card, passport or driving licence), on the basis of which you are identified by the notary. Certain contracts also require submission of other documents. If you do not possess any identity document, your identity can be verified by two persons of legal age with their own identity documents. 

You can, of course, verify signatures on other documents as well (statements, certificates, etc). 

A notary is not liable for the content of the deed and is not obliged to identify whether the parties are legally allowed to enter into the deal to which the deed relates in case the deed was drawn up by the third party or yourself. The content of the deed is only taken into account if the verification of a signature requires fulfilment of certain conditions bound by the law.

If the law stipulates that a deed must be in the form of a notarised record, the notarised signature on such deed is not possible.

Notarised copies of documents

Do you need a notarised copy of your document? Bring the original and the notary will make a photocopy of the original and certify it to be a true and accurate copy of the original document.

Notarised translations

A notary can verify that the translation is accurate and faithful to the original only if he or she is a sworn translator for the language of the translated document.

Apostille – international verification

If you need an international verification of a document, an additional verification is required (APOSTILLE) according to the Act on verification of documents in international traffic Zakonom o overitvi listin v mednarodnem prometu (Ur.l. RS, no. 64/2001). The apostille is the international verification that a document has been certified in the country of origin.  Apostille can be issued at the district court where the notary is seated or at the Ministry of Justice and Administration of the Republic of Slovenia. The apostille is not required if an international treaty provides otherwise.
