Contracts of inheritance
Are you a real estate owner and would like to transfer it to your descendants to prevent a possible dispute of inheritance? Would you like to make sure you get the necessary protection and assistance in the old age, but still remain the owner of the property during you lifetime? Are you without the immediate family, but are already looked after by a nephew or a niece to whom you would like to transfer you property in return for their care?
Refer to a notary. You can discuss these issues and he/she will advise you towards the most appropriate solution. If your descendants are unanimous about the distribution of your property and who will provide care for you, a notary can draw up the contract on the delivery and distribution of property during your lifetime, where it is specified which heir or heirs will inherit the property in turn for their care, with the expressed consent of other heirs. If you would like to remain the property owner during your lifetime, the contract of the lifetime maintenance will be your best solution. If you wish your heir to inherit your property after your death a notary can also draw up the contract of donation for the case of death and promises to make gifts.
The contract on renunciation of the inheritance can also be drawn up in which the descendant waives irrevocably and finally the inheritance after his/her death. Such agreement can also be an independent legal matter.
According to the law, all the above contracts must be drawn up in the form of a notarial record, therefore a visit to the notary is your best option.
